President Ratifies First Amendment to Copyright Act

President Dr. Mohamed Muizzu has ratified the First Amendment to the Copyright and Related Rights Act, marking a significant step forward in strengthening intellectual property rights in the Maldives. The amendment, passed by the Parliament during its 56th sitting on December 2, 2024, introduces key changes aimed at modernizing copyright legislation and addressing its previous limitations.

Key Highlights of the Amendment:
  • Extended Protection Period:The copyright protection period has been extended from 50 years to 70 years, aligning with international standards and providing creators with prolonged rights to their works.
  • Clarification of Eligible Materials:The amendment offers detailed guidelines on the types of works eligible for copyright protection, encompassing literature, art, performances, voice recordings, and broadcasts, regardless of their presentation, purpose, or quality.
  • Exemptions for Accessibility and Non-Commercial Use:To promote inclusivity, specific exemptions have been introduced for individuals with disabilities, allowing them to access copyrighted materials in accessible formats. Provisions for non-commercial uses are also included to encourage educational and cultural dissemination.
  • Legal Recourse for Infringement:Copyright holders are now empowered to pursue legal action in relevant courts against cases of infringement or perceived violations, strengthening enforcement mechanisms.
Impact and Implementation:

The amendment aims to provide more comprehensive protection for creators, ensuring their rights are safeguarded in the evolving digital and creative landscape. By expanding coverage and extending the protection period, the legislation is expected to foster innovation and creativity across various sectors.

Following the President’s ratification, the amendment has been published in the Government Gazette. It is set to come into effect three months from the date of publication, giving stakeholders time to adapt to the new regulations.

This milestone reflects the Maldives' commitment to supporting creators and aligning its copyright framework with global standards, encouraging a vibrant and sustainable creative economy.
